It is increasingly popular for couples to live together without being married. They cohabit and own a house together. When a cohabiting relationship ends, it can be difficult as it is unclear on how the former family home should be dealt with. Most client’s are unaware of the law surrounding this area which is commonly known as TOLATA which stands for the Trust of Land and Appoint of Trustee Act 1996. Separations are dealt with by one party buying the other out of the former family home or putting the home up for sale. It depends on what each the ability to buy out the other.
Sometimes it can be as straightforward as sending a Solicitor’s letter to the other side with an offer which can then either be negotiated or agreed upon. If this is not successful, then mediation may be appropriate. However, this would not be appropriate if, for example, there has been domestic abuse. If mediation is not appropriate or an agreement cannot be reached at mediation, then a court application may be necessary. We will carefully consider your options with you and agree the right course of action for you and your family.

Initial funding consultation for new clients
We offer prospective clients with an initial consultation to discuss funding. This is done via a phone call and takes approximately 5 to 10 minutes. In this phone call we will ask you questions to ascertain if you are eligible for Legal Aid. If you are not eligible for Legal Aid then we will provide you with an estimate for private funding. We are unable to provide advice in these phone calls but we can book a fixed fee meeting where we can provide advice.
During the first stages of any separation, a lot of clients wish to understand the options to resolve the former family home and what the financial implications are. This helps them to start planning. We offer a one hour fixed fee meeting at £180.00 inc. VAT. In this meeting we can understand your situation and provide some initial advice via Microsoft Teams.
